When you hire your first worker, it's a big moment for your business. But becoming an employer means you have lots of new responsibilities. You'll need to follow local tax rules, employment laws, and tell LHDN how much you pay your employee and take from their salary. In this guide, we'll explain the important steps you need to take as a new employer to make the transition smoother. It also provides a comprehensive guide for employers on how to register with EPF, SOCSO, LHDN, and EIS.

 

Registration for Employee’s Provident Fund (EPF)

According to Section 41(1) of the EPF Act 1991, when a company hires its first employee, it has to register with EPF within 7 days. If the company is registered with SSM, it can do this online registration. here are the documents you need:

1. Form KWSP 1

2. Form 49/ Superform (acquire from SSM)

3.  Copy of the Sole Proprietor/ Partner/ Director's identification (MYKAD/ PASSPORT)

4. Certification of Company/Business Registration (acquire from SSM)

Alternatively, you can also prepare the documents below:

  • Section 15 - Notice of Registration
  • Section 14 - Application For Registration Of A Company
  • Section 17 - Certificate Of Incorporation Of Private Company

Once you have all the papers listed, go to any EPF office to sign up. After signing up successfully, you'll get:

  • Employer's Reference Number
  • Notice of employer registration
  • Employer's Registration Certificate (to be displayed at employers' premises)

Tip 1: You can sign up under more than one number to make paying easier.

Tip 2: Besides signing up as an employer, you'll also need to sign up as a user to pay online.

Registration for Social Security Organization (SOCSO)

Employers must sign up with SOCSO within 30 days of hiring workers. To begin, create an account on the PERKESO Assist Portal. SOCSO's role involves offering social security coverage, such as cash benefits, to private sector employees in cases of workplace injuries, emergencies, occupational illnesses, and fatalities. Then, proceed to register with SOCSO by filling out the required forms on the portal and submitting necessary documents:

1. Employer's Registration Form (Form 1)

2. Employee's Registration Form (Form 2)

3. Other Supporting Document according to your Company Type

To use the ASSIST Portal, fill out the Borang Permohonan Enrolment Penggunaan Portal Assist and send it to [email protected].

Also, if you stop being an employer, tell SOCSO by uploading Form 1A and papers within 30 days on the ASSIST Portal.

 

Registration for LHDN

e-Daftar is a website where new taxpayers can sign up for their tax files and get their tax reference numbers. It's part of MyTax. Employers can also use e-Daftar to register and get their E number by selecting "Employer" on the online form.

After filling out the form, employers need to enter their application number on this website to verify the application status, upload the necessary documents listed below, and print registration details once the registration is successful.

The following documents will need to be uploaded:

  1. Copy of SSM Form 9

  2. Copy of SSM Form 49

  3. Copy of SSM Form 13 (if company has changed name)

e-Daftar applications will be canceled if all necessary documents are not received within 14 days from the date of application.

 

Registration for Employment Insurance System (EIS)

PERKESO launched the Employment Insurance System (EIS) in January 2018 to support workers who lose their jobs due to layoffs or other reasons for up to 6 months. Employers are responsible for contributing to the EIS fund managed by the Social Security Organization (SOCSO). 

Employers who haven't signed up with EIS can do so through the ASSIST portal. If you don't have an ASSIST account yet, you need to fill out the Borang Permohonan Enrolment Penggunaan Portal Assist and email it to [email protected].

Tip 1: Employees are only covered once their employer registers with SOCSO. Employers must fulfill this duty or could face legal action.
